NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

Visionloan, Inc. d/b/a Vision Mortgage Group (“Vision”) knows that you expect it to maintain the privacy and security of your personal information that is in our possession. The purpose of this notice is to explain to you how Vision collects, uses and safeguards Nonpublic Personal Information. Nonpublic Personal Information includes personally identifiable financial information you provide to Vision or data that is not publically available that Vision obtains using your personally identifiable financial information such as, for example, your name, address, telephone number, date of birth, social security number, employment information, income data, information from your lenders and credit references.

This Notice also tells you how you can limit our disclosure of Nonpublic Personal Information about you.

Categories of Information Collected and its Source

As part of providing financial products or services to you, we may collect Nonpublic Personal Information about you from the following sources:

• Applications, forms and other information that you provide to us, whether in writing, in person, by telephone, electronically, or by any other means. 
• Your transaction with us, our Affiliates or others.  This may include information from third parties about your transactions with them such as account balances and payment histories.
• Consumer reporting agencies.  This information may include account information and information about your creditworthiness.
• Public sources.  This information may include real estate records, employment records, telephone numbers, etc.

The Information We Disclose

We do not sell our client’s Nonpublic Personal Information to anyone and only disclose Nonpublic Personal Information about you with your consent or as permitted by applicable law:

To Our Affiliates: Unless expressly prohibited by applicable State Law, we may disclose your Nonpublic Personal Information to our Affiliates to assist us in servicing your account, to process your transaction(s), and to let you know about products and services offered by us and by our affiliated companies, to manage our business and as otherwise required or permitted by law.  “Affiliates” means any company that controls, is controlled by, or is under common control with another company.  At the present time our affiliates include: Vision Insurance Group, Inc.

You may direct us to not share with our Affiliates the Nonpublic Personal Information about you that was collected by Vision as part of your transaction(s) by “opting-out”. You may also limit our Affiliates from marketing their products and services to you based upon personal information we share with them. Please see the instructions below for “opting-out”.  Under applicable law, however, Vision may still share your Nonpublic Personal Information with our Affiliates under certain exceptions or for purposes not subject to the right of opting-out and we may continue to share public personal information about you with our Affiliates.

To Our Third Party Service Providers and Joint Marketers: We may share all of the Nonpublic Personal Information we collect about you with third party service providers that provide services on our behalf and which we deem necessary in order to effect, administer or enforce the transaction(s) between you and Vision (such as companies that provide flood hazard insurance determinations and property tax information). We may also share the Nonpublic Personal Information we collect about you with companies and/or financial institutions with whom we have a joint marketing agreement or a written contract pursuant to which those companies or financial institutions and Vision jointly offer, endorse or sponsor a financial product or service. Under Federal Law, this type of sharing is not subject to a right to “opt-out” but it may be limited under certain applicable State laws (e.g., California and Vermont). Please note that these Third Party Service Providers and Joint Marketers are obligated to not release, use, or transfer any of your Nonpublic Personal Information to any party for any purposes other than to carry out the permitted services.   Vision and Vision Insurance Group, Inc. are parties to a Joint Marketing Agreement.

Nonaffiliated Third Parties: We limit who receives personal customer information, but periodically we are required to disclose some or all of your Nonpublic Personal Information to nonaffiliated third parties where you do not have the right of opting-out including disclosure to: third parties such as law enforcement agencies investigating fraudulent or potentially illegal activity; to credit reporting agencies; government agencies or regulatory agencies; loan investors or other financial institutions holding a legal or beneficial interest relating to you or your loan; to comply with a subpoena or other requests from authorized government authorities; to protect the confidentiality or security of records, to resolve consumer disputes or as otherwise required by Federal, State or Local laws. 

We may also share certain Nonpublic Personal Information we collect about you, (your name, address, phone number, e-mail address and other identifying information and details regarding your loan transaction history and experiences with us) your businesses that can provide you products and services that we do not offer (such as life insurance and other financial products). If you do not want this information shared in this manner, you can direct us not to share it. Please see the instructions below for “opting out”.

The Confidentiality and Security of Your Nonpublic Personal Information

Vision restricts the access to your Nonpublic Personal Information to those employees who need to know the information in order to provide products and/or services to you. Our employees are required to maintain the confidentiality and privacy of our customers. We maintain physical, electronic and procedural safeguards that comply with federal regulations and guard your Nonpublic Personal Information. In that regard, we employ password protected systems and applications as well as other safeguards (e.g., locked file cabinets).

Your Privacy Choices-Opting Out

As we respect our customers’ privacy, we give you a choice as to how your Nonpublic Personal Information may be used. No action is required if you want to enjoy the benefits of product and service offers by allowing us to share information with our Affiliates and non-affiliated third parties. Otherwise, you may limit how we share Nonpublic Personal Information by “Opting-Out”. Please provide your name, address including city and state of the property and our file number.  Please note that even if you decide to opt-out, we will still share Nonpublic Personal Information about you, as indicated above, with companies that perform services on our behalf and with third parties as otherwise required or permitted by Federal, State or Local law.
